Patent Lawsuit Appealed

WASHINGTON—Moore U.S.A. Inc. appealed the summary judgment issued in its patent infringement case against Standard Register. The IMR reported in the May 26 issue that SR was granted summary judgment on noninfringement in defense of all four claims of patent infringement alleged by Moore. The patents involved affect the manufacture of pressure seal products. The case was tried in the U.S. District Court for the Eastern District of Virginia, Alexandria Division.

In considering a motion for summary judgment, the court does not weigh evidence, but decides whether or not there is a genuine issue for trial. Moore appealed the case May 14 to the United States Court of Appeals for the Federal Circuit, Washington, D.C. Standard Register subsequently filed a cross appeal May 19. In the meantime, SR continues to manufacture its IMAGE SEALŪ product.

Readers should note that the May 26 article about the case contained a typographical error. The correct patent number for the patent in the Moore/Standard Register case for a double fold mailer developed for use with pressure sealing systems is U.S. Patent No. 5,314,110.
